Your privacy is important to MAG Builders, Inc. (“MAG”). This Privacy Policy discloses MAG’s practices with respect to (i) the personal information we gather in connection with your request for information regarding our products and services, (ii) MAG’s public website, including the type of information that we gather, (iii) the way we use information internally; and (iv) our policy regarding sharing your personal information with others.
We have implemented these practices for MAG’s website (www.MAGBuilders.com) and dependent pages (the “Site”). We have instructed our website administrator to include information regarding these privacy practices anywhere on the MAG Site where Personal Information is collected.
Additionally, because we use visual mapping services on our website, please be aware that the Google Maps/Earth Terms of Service, including the Google Privacy Policy, at http://www.google.com/help/terms_maps.html also applies.
We encourage you to read this Privacy Policy. This policy addresses our privacy practices relating to visitors to the Site and registered users of the Site. For purposes of this Privacy Policy, "Personal Information" is information which you provide to us which personally identifies you, such as your name, email, address or billing information, or other data which can be reasonably linked to such information. Generally, you may browse the Site without providing any Personal Information. However, we may ask that you provide information, including, without limitation, Personal Information, at various times and locations through the Site. For example, if you decide to register with the Site to save projects you are working on, you will be asked to provide information such as your name, user name, password, and e-mail address. When using forms on the Site to communicate with MAG, you may choose to provide other Personal Information, such as your name, company name, mailing address, home phone number, and email address. We may also ask for your credit card information if you choose to purchase services through the Site. We may collect and store any Personal Information you enter through the Site.

We use commercially reasonable measures to ensure that Personal Information gathered about customers interested in MAG’s products and services is only accessible by appropriate personnel who have a business need for the information. DOMAIN NAME AND IP ADDRESS
We collect the domain names and IP addresses of our visitors for statistical purposes, to measure use, to improve the content or responsiveness of our site or to customize the content or layout of the site for the individual visitor. We do not disclose this information to third parties. We may also aggregate information relating to our visitors’ traffic patterns from the data that we collect and retain concerning the IP addresses and domain names of our visitors, and we may divulge such aggregate information about our users with third parties such as our business partners, distributors, and service and support providers. LOG FILES

We collect e-mail addresses that are: volunteered by the visitor; through e-mail messages addressed to our company or its employees; through visitor responses via the “contact us” portion of the site; or e-mail marketing destination web pages and public events. We use e-mail addresses for marketing purposes and to inform those interested in our products about events, products, services or other items of interest. We may also use e-mail addresses volunteered by our visitors to register the visitor for an extranet account, to process orders for brochures and other written materials, or otherwise to respond to a visitor’s request. This opt-out procedure will not be available for administrative messages such as e-mails that are necessary to provide confirmation of a completed transaction (such as a purchase, service request or change in the visitor’s user profile) or e-mails that confirm a visitor’s status as a registered user of the MAG customer extranet.
OTHER PERSONAL INFORMATION
We may use a mailing address or phone number that a visitor provides for a variety of MAG-related reasons. We may send periodic mailings to visitors or make telephone calls to inform those visitors who have provided a mailing address or telephone number of new products, services or events. Website Visitors. Like most website operators, MAG collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. MAG’s purpose in collecting non-personally identifying information is to better understand how MAG’s visitors use its website. 

MAG uses remarketing services to advertise on third party websites (including Facebook and Google) to previous visitors to our site. It could mean that we advertise to previous visitors who haven't completed a task on our site, for example using the contact form to make an enquiry. This could be in the form of an advertisement on the Google search results page, or in your Facebook news feed. Third-party vendors, including Google, use cookies to serve ads based on someone's past visits. Of course, any data collected will be used in accordance with our own privacy policy and their privacy policy. You can set preferences for how these external sites advertise to you using the Google Ad Preferences page, and if you want to you can opt out of interest-based advertising entirely by cookie settings or permanently using a browser plugin. 
REFERRAL SERVICES
We may offer functionality on our website that allows you to tell a friend about our services. If you choose to use our invitation service to tell a friend about our services, we will ask you for information needed to send the invitation, such as your friend’s email address. We will send your friend an email message inviting him or her to visit or try our services. By providing email addresses or any other contact information of third parties to us, you represent and warrant that you have the right to do so, and you acknowledge and agree and that such information may be used for this purpose. We store this information to send the email invitation, to credit for referrals, and to track the success of our referral program. Your friend may contact us at info@MAGBuilders.com to request that we remove his or her email address from our database.
COOKIES
A cookie is an element of data that a website can send to your browser, which may then be stored on your system. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether to accept it. MAG uses one type of cookie to maintain your login information for as long as you are using one of our website. No Personal Information is stored in this cookie and the cookie is deleted from your computer when you leave the website. Our second cookie type simply identifies you as you move throughout our website, providing faster, personalized access to view various site pages.
DATA SECURITY
We safeguard the security of the data you send us with certain physical, electronic, and managerial procedures. We take commercially reasonable precautions to protect against misuse, theft, loss, unauthorized access, disclosure, alteration or destruction of your Personal Information. The site and the functions, facilities and services related thereto (“the Site”) are proprietary services operated and maintained by MAG BUILDERS, Inc. (“MAG”). This Terms of Use Agreement (“Agreement”) contains the terms and conditions on which MAG is willing to permit your use of the Site and you must accept these terms and conditions for use of the Site. Your use of the Site signifies your agreement to the terms and conditions of this Agreement. MAG’s trade names, trademarks, service marks and trade dress may not be used in connection with any product or service that is not MAG’s, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits MAG. All other marks not owned by MAG that appear on this Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by, MAG.
4. USER INFORMATION; PRIVACY

You acknowledge that MAG will not be responsible for any injuries or damages connected with the use of, loss of use of, or inability to use, the Site. MAG has the right to amend this Agreement at any time by posting the amended Agreement on this Site. The amended Agreement will be effective on the date specified in the posting. Your use of the Site following the effectiveness of any notice of amendment will indicate your acceptance of the amended Agreement.
9. GOVERNING LAW AND JURISDICTION
This Agreement and all other aspects of your use of the Site shall be governed by the laws of the State of California, without regard to its conflicts of laws principles. The parties submit to the exclusive jurisdiction of and agree that all claims and disputes arising out of this Agreement or your use of the Site shall be submitted to and resolved by binding arbitration in San Francisco, California pursuant to the rules of the American Arbitration Association, and shall not be consolidated in any arbitration with any claim or controversy of any other party. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. Either you or MAG may seek interim or preliminary relief from a court of competent jurisdiction necessary to protect the rights or property of you or MAG pending the completion of arbitration.
10. ENTIRE AGREEMENT
This Agreement and all materials incorporated herein by reference constitute the entire understanding between you and MAG with respect to your rights and obligations as a user of the Site. If any provision of this Agreement is held to be unenforceable, that provision shall be struck and the remaining provisions shall be enforced to the fullest extent permissible by law. The failure of MAG to enforce any provision of this Agreement at any time is not a waiver of said provision or right or any other present or future provision or right.
11. LINKS TO THIRD-PARTY SITES
The links included within this Site may allow you leave the Site and visit third party sites. These third party sites are not under the control of MAG. MAG is not responsible for the contents of any third party site nor is MAG responsible for the functionality of any third party site. MAG provides links between our Site and third party sites to you strictly as a convenience. A link’s inclusion in this Site does not constitute an endorsement of the third-party site or its operators or of the goods or services provided by or accessed through said site.
12. ADVERTISERS AND PROMOTIONS
Any promotions sponsored by advertisers on the Site or your dealings with said advertisers are matters solely between you and that advertiser or third party. MAG is not responsible in whole or in any part for any such connections or dealing with advertisers, third parties or their promotions.
13. PRICE DISCLAIMER
The price for each MAG home displayed on this Site includes factory construction of the home (with materials, fixtures and finishes), standard delivery, and onsite finish work by our crew; all such prices are subject to change without notice. Additional charges may apply based upon geographic location, site-specific conditions and applicable state and local sales tax. Other home-building costs to consider, which are not included in the price of a MAG home, include local permitting, site excavation, foundation construction, utility hook-ups, final painting and the incorporation of other site improvements, such as decks, landscaping and driveways.
